Comprehensive Terms and Conditions
Mobile Batting Simulator
1. Liability Waiver & Safety Disclaimer Participants acknowledge and fully understand that batting cage activities involve inherent risks, including but not limited to injury from swinging bats, pitched balls, or accidental collision with equipment or other participants. By participating, attendees expressly accept these risks and agree to hold harmless and fully indemnify Nashville Lions Cage (NLC), its employees, affiliates, contractors, and any associated parties from any claims, liabilities, injuries, or damages arising from or related to the use of the simulator, regardless of the cause, including negligence or equipment malfunction.
2. Liability Insurance NLC maintains comprehensive commercial general liability insurance coverage up to $1,000,000 per occurrence. This insurance coverage protects both NLC and its customers in the event of an accident, property damage, or injury directly associated with the operation of the mobile batting simulator. Upon request, NLC can provide clients with a Certificate of Insurance (COI) to verify this coverage. Customers requiring NLC to name additional insured parties must request this at least five business days prior to the scheduled event.
3. Participant Supervision & Conduct Participants under the age of 16 must always be accompanied by a responsible adult (18+ years old). Adults supervising minors explicitly agree to remain vigilant and actively involved in the supervision process, ensuring adherence to all safety and usage guidelines provided by NLC staff. Participants and supervising adults agree to maintain respectful and appropriate conduct at all times. NLC reserves the right to terminate participation of any individual who compromises the safety or experience of others without refund.
4. Equipment Use & Property Damage Customers accept full responsibility for all equipment rented or provided by NLC. Participants must use equipment solely as instructed. Customers agree to promptly report any damages, malfunctions, or unsafe conditions immediately to NLC staff. Damage resulting from negligence, intentional misuse, vandalism, or failure to follow instructions provided will result in additional fees or charges for repair or replacement, assessed at fair market value.
5. Set-Up & Space Requirements The customer agrees to provide adequate space, a safe surface, and unobstructed access for the simulator setup and operation. This includes, but is not limited to, a flat, even surface free of obstacles and sufficient clearances overhead and around the batting area. Customers must provide reliable electrical supply if previously agreed upon at the time of booking. If the location does not meet these requirements upon arrival, NLC reserves the right to cancel the booking immediately without refund or to charge additional fees if adjustments are required.
6. Payment Terms & Pricing
Pricing stated at booking confirmation is final and binding.
A non-refundable deposit, determined at the time of booking and clearly outlined in your booking confirmation, is required to secure the reservation.
Full payment of the remaining balance is required no later than 24 hours prior to event commencement. Failure to make timely payments may result in event cancellation without refund.
Payment options include major credit/debit cards (Visa, MasterCard, American Express, Discover), electronic payments (PayPal, Venmo, Cash App), bank transfers (ACH), and cash or check payments (by prior agreement only).
7. Cancellation & Refund Policy
Cancellations made more than 72 hours prior to the scheduled event will be eligible for a full refund of the deposit.
Cancellations made between 24 to 72 hours prior will be eligible for a 50% refund of the deposit.
Cancellations made less than 24 hours prior to the event are not eligible for any refund of the deposit.
If inclement weather conditions (rain, high winds, severe weather warnings) prevent the safe operation of the simulator, customers may reschedule the event to a mutually agreed-upon date without additional charges, receive a full refund, or apply a credit toward a future booking. Additionally, if a customer's ongoing reservation time is reduced by 50% or more due to inclement weather, NLC will prorate charges and provide refunds for any unused simulator time.
8. Overtime & Additional Charges If an event extends beyond the booked rental period, overtime will be billed at a specified rate per half-hour increment. Customers must approve overtime in writing at the event. NLC reserves the right to charge customers post-event for overtime accrued without explicit prior approval if it disrupts subsequent bookings or operations.
9. Additional Fees for Excessive Cleaning or Damage Customers agree to cover costs for excessive cleaning or damages beyond normal wear and tear as determined by NLC staff upon post-event inspection. Examples include, but are not limited to:
Stains or spills requiring specialized cleaning services
Damages to nets, screens, or batting mats caused by misuse
Excessive litter, food waste, or debris left at the event site
Physical damage to equipment, structures, or property due to negligent or reckless behavior
Such costs will be itemized and charged separately, and payment is due immediately upon receipt of the invoice.
10. Emergency Procedures & Reporting Customers must immediately inform NLC staff of any injuries, medical emergencies, unsafe conditions, equipment malfunctions, or accidents occurring during the event.
11. Participant Orientation Customers agree to ensure that all participants attend a brief safety orientation provided by NLC staff prior to using the batting simulator. Failure to attend or comply with this orientation may result in termination of participation without refund.
12. Alcohol, Food & Beverage Policy Food, beverages, and alcohol are permitted around and near the simulator area. However, no food, drinks, or alcohol are allowed inside the batting simulator itself. Customers are responsible for ensuring all guests consume alcohol responsibly. NLC reserves the right to refuse service or terminate events where participants become unsafe or disruptive due to alcohol consumption.
13. Accessibility Accommodations Customers with accessibility or special accommodation requests must notify NLC at least 48 hours prior to the event to determine if suitable arrangements can be provided.
14. Force Majeure NLC shall not be liable for cancellations or delays caused by factors beyond reasonable control, including but not limited to severe weather, natural disasters, governmental regulations, or health emergencies.
15. Late Payments & Non-Payment Payments not received by due dates will incur late fees of $35 per occurrence. Checks or electronic payments returned due to insufficient funds will result in additional fees, and NLC reserves the right to seek collection through legal means. Customers will also be liable for any legal or collection expenses incurred.
16. Right to Refuse or Terminate Service NLC reserves the absolute right to refuse service or terminate any event if customers or participants exhibit unsafe, disrespectful, or disruptive behavior. Termination under these circumstances will result in no refund or credit being issued.
17. Disputes and Adjustments Billing or service disputes must be reported in writing within 5 business days following the event date. NLC will investigate and respond to valid concerns promptly and fairly. Adjustments, if necessary, will be credited or refunded accordingly.
18. Media Consent Participants acknowledge that photos or videos may be taken during events for promotional or marketing purposes. Consent is given to NLC to use such media unless explicitly revoked in writing prior to the event.
